Conditions
The vehicles are offered for sale by Aquitaine Enchères Automobiles, Toulouse Enchères Automobiles, SCP Arnauné-Prim ("the Auctioneer") on behalf of various consignors ("Sellers"). All vehicles are offered by the Auctioneer as agent for the Seller.
The Auctioneer is not a party to the sale agreement, which is solely binding on the seller and the successful bidder.
Vehicle specifications
Vehicles are sold "as is" which means without any sort of guarantee regarding vehicle conditions and mileages.
The auctioneer reserves the right to withdraw any vehicle before or at the sale.
Viewing
The information included in the catalogue is prepared with the care required for public auctions, subject to the notices, declarations and amendments announced upon presentation of the item and noted in the record of sale.
The information is provided to help the potential buyer to inspect vehicles and must be assessed personally by him. If no information is provided in the catalogue or during a verbal announcement, this does not mean that the vehicle is void of defects.
The information given is provided free of charge and solely to serve as an indication. It shall by no mean incur the liability of the Auctioneer.
In as much as buyers are given the opportunity to examine vehicles prior to the sale, no claim may be made after the sale is complete.
Bids
Purchases are made in euros.
The fall of the auctioneer's hammer indicates the final bid. As soon as an item is pronounced "sold", it shall be placed under the sole responsibility of the buyer.
The buyer shall forthwith assume full risk and responsibility for the vehicle and shall pay the full purchase price.
Buyer's Fee
The purchase price is the sum of the final bid price plus the buyer's premium and vehicle inspection price.
The buyer's premium varies following the sale's type :
voluntary: 11.960 % VAT included
legal: 14.352 % VAT included
administration : 15.000 % VAT included

The VAT status of the vehicle is mentioned on the vehicle' specification sheet and in the catalogue. "Yes" means that the vehicle is sold with VAT included in the hammer price. "No" means that the vehicle is sold without VAT included in the hammer price.
Payment by French citizens
Payment is made by one of the following methods :
cheques drawn on a French bank with a letter of credit from the bank for an amount equivalent to the price to pay plus two ID cards
bank cheques drawn on a French bank
bank transfers
A 2000 euros deposit is required immediately.
Payment by non French citizens
Payment is made by one of the following methods :

Non - payment
In accordance with Article 14 of French Act 200-642 of July 10th 2000, if the successful bidder fails to pay for an item after the issuance of a formal demand that remains without effect, the item shall be re-auctioned. If the price of the new bid is lower than the original false bidder's price, the false bidder shall pay the difference.
Collection of vehicles
Buyers are to collect the vehicles as soon as possible. The auctioneer is not responsible for the storage of purchased vehicles.
Vehicles have to be insured before collection.
From the moment the hammer falls, sold vehicles will become the exclusive responsibility of the buyer. The buyer will be solely responsible for the insurance, the Auctioneer assumes no liability for any damage to vehicles which may occur after the hammer falls.
Items are offered for sale on the condition that any buyer intending to sell or use such item will take the necessary measures to certify the item and as required under the European Union Legislation and as implemented in the national legislation of the relevant Member country.
If payment is made by cheque or wire transfer, vehicles may not be withdrawn until the payment has been cleared.
Jurisdiction
These general terms and conditions of sales, the sale and all matters relating thereto are governed by French law; the sellers, buyers and their agents accept that the courts of Toulouse (France) alone shall have jurisdiction over any legal action.
